1 WHAT IS OUR VISION ON PRIVACY?

Your satisfaction and trust in Body & Shape Store™ are of great importance to us. That is why we have established a privacy and security policy for customer data that describes how we use your personal data. The most important rules that apply are based on seven principles.

The following seven principles apply within Body & Shape Store™.

Transparency: when collecting and processing your personal data, we communicate all information to you and inform you of the purpose and recipients of the data.

Necessity: we only collect personal data that is necessary for the processing of that data. We take all reasonable measures to ensure that the personal data we hold is accurate.

You may also object to the use of your personal data, in particular to prevent you from receiving advertising and marketing information. Confidentiality and security: we ensure that reasonable technical and organisational measures have been taken to protect your personal data against misuse, unlawful loss or unauthorised use, disclosure or access.

Sharing and international transfer: we may share your personal data within the Body & Shape Store™ group or with third parties (such as commercial partners and/or service providers), solely for the purposes of this policy. We take appropriate measures to safeguard security when sharing and transferring that data.

4 WHAT PERSONAL DATA DO WE PROCESS?

We require certain data from you, such as when making information requests and when visiting our websites. In these cases, we process data. We also make use of third parties who receive certain personal data and process it on behalf of Body & Shape Store™. This happens, for example, for the dispatch of your confirmation, the sending of brochures and mailings, the sending of personalised offers or the processing of a survey you receive from us after going live.

We may need to contact you. We will call if there are any questions, and may send you a message, for example.

b. IP addresses

On the internet, we or third parties on our behalf may look at your IP address. We remember your preferences and can thus provide appropriate advice. This may also be used for fraud protection.

Online forms (contact forms, questionnaires, Body & Shape Store™ pages on social media, network registrations such as sign-up via Facebook, and so forth).

7 HOW AND TO WHOM DO WE GRANT ACCESS TO YOUR PERSONAL DATA?

a. Within Body & Shape Store™ we may share your personal data and grant access to it to authorised personnel within the group, including:

IT departments

Commercial partners and marketing agencies

Legal services, where applicable

b. With service providers and partners: your personal data may be sent to a third party for the purpose of providing services and improving your experience, such as external service providers, IT subcontractors; always exclusively for the purposes described herein.

c. Local authorities: We may be required to send your data to local authorities if required by law, or as part of an investigation and in accordance with local regulations.

8 HOW DO WE PROTECT YOUR PERSONAL DATA DURING (INTERNATIONAL) TRANSFER?

For the purposes of article 7 of this policy, it is possible that we transfer your personal data to recipients who may be located in countries with a different level of personal data protection.

Therefore, Body & Shape Store™ has also taken appropriate measures to ensure a secure internal transfer of your personal data or to an external recipient located in a country with a different level of privacy than that in the country in which the personal data is collected.

9 HOW DO WE SECURE YOUR PERSONAL DATA?

Body & Shape Store™ takes all appropriate technical and organisational measures, in accordance with the applicable legal provisions, to secure your personal data against misuse, unlawful loss or unauthorised use, disclosure or access. To this end, we have implemented technical measures (such as firewalls, file access monitoring), a robust username/password system, physical security, and so forth. Should a data breach occur despite these measures, we have a procedure for reporting it in the proper manner.

We also expect external parties that process personal data on our behalf to have implemented the required contractual and organisational measures to do so as securely as possible and to likewise guarantee that they process your data solely for the purposes described herein. We will formalise this as much as possible and where possible also supervise compliance. In addition, we maintain an up-to-date overview of these external parties and which specific data they process on our behalf and for what purpose.

10 WHAT ARE THE LEGAL BASES FOR OUR DATA PROCESSING?

For the processing of personal data, the law recognises various so-called legal bases. These primarily concern the processing of data on the basis of:

an agreement;

a legitimate interest of Body & Shape Store™;

given consent;

a legal obligation.

We use your data primarily in connection with information requests and therefore on the basis of an agreement with you. Additional contact moments, such as reviews, marketing activities and the recording and analysis of your actions, are carried out in connection with a legitimate interest of Body & Shape Store™. You can also subscribe to a newsletter yourself. In that case, you give us your consent to use your data for this purpose. There are also legal obligations, such as for example recording your details in the night register.

11 WHAT ARE COOKIES AND WHAT DO WE DO WITH THEM?

Body & Shape Store™ and others use cookies to analyse websites, make them more user-friendly, offer social media features and show you relevant offers on and outside the website.

13 HOW DO YOU GAIN ACCESS OR INSIGHT INTO YOUR PERSONAL DATA?

You have the right to access your personal data as collected by Body & Shape Store™. Upon request, we will inform you whether and which personal data we process about you. Furthermore, you can request this data and under certain circumstances have it corrected, supplemented, deleted or shielded, for example if it is inaccurate. This may result in you no longer being able to make use of (part of) our services or us being less able to serve you effectively.
